I report, you decide.

The toxicology reports on the Irbys are complete and have been sent to JPD. Unfortunately, JPD refuses to release this information. The Clarion-Ledger reports:
"The Jackson Police Department knows whether alcohol or drugs played a role in a crash that killed two doctors but is withholding the information so it can be presented to a grand jury.
JPD investigators will turn over the information to the Hinds County district attorney's office.
"The results are evidentiary in nature and, therefore, cannot be released," police spokesman Lt. Jeffery Scott said Friday. "It is part of our policy not to release toxicology results. That's the way we've always done it, and this case is no different
." (By the way, grand jury proceedings are sealed.)

Lets see if this is true or not and also how long it takes to get toxicology reports. Here are some news stories I dug up online:

A 20-year-old Madison County woman was arrested near Hattiesburg Tuesday morning and charged with driving under the influence causing death.
Shelby Leigh Brown, a University of Southern Mississippi student, turned herself into Petal police around 10:00 Tuesday morning. Brown was involved in an accident that resulted in the death Kaitlyn Bryant, 20, of Sumrall earlier this month.
Investigators say toxicology results showed that Brown was over the legal limit at the time of the accident.

"Starkville 04/27/08 DUI Manslaughter Charges in MSU Accident (KF Note: this was ONE DAY after the wreck)
A Starkville man faces a DUI-Manslaughter charge following a fatal crash Saturday at Mississippi State University. Joshua Buckner, 20, and three others were reportedly traveling on the MSU campus when their vehicle struck a light pole near Bryce Griffis hall.
Buckner is being held at the Oktibbeha County jail. Bond has not been set pending further investigation.
Charlesy Collins, 19, also of Starkville, died in the crash. He was a student at East Mississippi Community College.
Two other passengers were treated and have been released

"Jackson 06/12/06 Man Faces Aggravated DUI Charge
A man arrested after a fatal car accident Saturday night is now charged with aggravated DUI. Kenneth Boclair is being held in the Hinds County Detention Center without bond. The wreck happened late Saturday at Highway-80 and Terry Road. Police say Boclair rear ended a pick-up truck. The truck's gas tank caught fire and its driver William Atlas was killed
." (KF Note: This arrest happened TWO days after the fatal wreck.)

Test results indicate the woman who crashed into two surveyors in Clinton last month had a blood alcohol level more than twice the legal limit.
Forty-four-year-old Connie Musgrove Brewer of Raymond posted her 51-thousand dollar bond. She is charged with DUI and DUI disfigurement/severe injury. Brewer is accused of driving into Jeremiah Howard and Brian Jones on Highway 80 in Clinton, severely injuring them both. Brewer's test results show she was under the influence of isopropyl alcohol with a blood alcohol content of .03% and acetone, with a blood alcohol content of .17% A date for a preliminary hearing will be set later in Clinton municipal court

"Byram 08/21/07Alcohol Detected in Driver Who Caused McGowan Wreck
Toxicology tests reveal a Jackson man had been drinking before last week's wreck that killed a Clinton firefighter and his wife.
The wreck happened August 12 in Byram. A truck driven by Christopher Spell, 26, collided with a Volkswagen occupied by Eddie and Vickie McGowand and their two daughters. The girls survived, but their parents died in the wreck.
Spell was not seriously hurt. No word yet on what his blood alcohol level was. The legal limit is 0.08. So far, no charges have been filed.
The McGowans' daughters are now living with their grandparents. A trust fund has been set up for them at BankPlus. Anyone can donate there or at the Clinton Fire Department, where Eddie McGowan was a captain

"02/29/08 Game Warden Charged with DUI after Fatal Crash
A Mississippi Department of Wildlife, Fisheries and Parks officer has been charged with three felony counts of aggravated DUI related to a crash in Oktibbeha County that killed two people and seriously injured another.
Twenty-five-year-old Ryan Crick was charged with leaving the scene of an accident involving injuries or death shortly after the crash on January 25th. The latest charges came on Wednesday, and he was released on a $15,000 bond.
Crick is a game warden who has been with the department for about four years. He lives in Ridgeland and works in Madison.
Crick has been suspended with pay from the Wildlife department since the accident.

"Jackson 02/28/08 Man Jailed after Wreck with Sheriff/Chief McMillin
Hinds County Sheriff and Jackson Police Chief Malcolm McMillin is back at work after his SUV was totaled in a crash Wednesday night. Nobody was seriously injured, but McMillin says he's sore, and he's not very pleased about what happened to his SUV.
McMillin says it happened as he was returning to Jackson from a Mississippi State University basketball game. A white Buick Park Avenue ran a red light and sideswiped McMillin's Ford Expedition around midnight at the intersection of Southwest and Gallatin streets.
The driver of the Buick, Michael Paul Davis, 26, is being charged with DUI, reckless driving and five other charges. Davis didn't have a driver's license or any insurance. He also had an expired inspection sticker.
"I haven't checked on him," McMillin said. "I'm not concerned with his welfare."
McMillin says about five officers came to his aid after the crash. He adds that Davis walked away from the scene and came back about fifteen minutes later.
Davis is being held at the Hinds County Detention center. No bond has been set

By the way, its normal for state lab to take this long. Here is an unrelated story I found on the CL online: "Lab tests key in 3 reservoir fatalitiesFebruary 1, 2000 •• 402 words •• ID: By Clay Harden/Clarion-Ledger Staff Writer The investigation of the Jan. 22 reservoir boating mishap that killed three people could languish for weeks until toxicology test results are in, officials say. Madison County Coroner Alex Breeland said Monday State Crime Lab test results could take up to two weeks to arrive. Preliminary inspections of the bodies by Breeland detected no obvious alcohol use or trauma but that lab results would be needed to confirm those findings."

I'm the one who posted those references to the dui's in Memphis and Florida.

I dont know the trigger, but it is clear that sometimes they do take longer to conclude an investigation. In this case, it appears, they are keeping evidence witheld because of pending
Grand Jury.

I think it would be a good idea for JPD to clarify their poicies.

In this case, it had been over a month before. The Irby case has barely gone two weeks.

There is NOTHING stopping JPD from arresting Karen Irby on any number of charges. Is McMillin now going to only arrest other DUI offenders only weeks and months after the DA has gotten around to presenting evidence to a grand jury? Of course not.

McMillin is BOUGHT AND PAID FOR. As if we needed any more proof after he set up that special precinct downtown to protect the other whites who have invested heavily into his campaigns.

McMILLIN, For god,s sake do the right thing any campaign mony from the Irby,s from now on will smell of blood!!!!!!!!Unless you uphold the oath that you took to protect the citizens of Mississippi.I,m sure that this was not the first that an Irby got behind the wheel while under the influnce of something.You must do the right thing you will be helping her more than you know,if not history will repeat itself,some where down the road this time it,s shame on Karen next time it will be same on you and you will have to live with it.

If McMillin is not protecting the Irbys, NOW is the time to step forth and prove it. Unless he is planning to retire at the end of this term, he is buying some very negative feelings toward himself.
On Clarion Ledger blogs, the Irby camp, or the privileged elite of Jackson (as if that was something to brag about!)works overtime belittling and attacking anyone that speaks truth and common sense.
Maybe it is because they realize but by the Grace of God, it could have been any one of them in the same situation. Those familiar with the Country Club set, and their obnoxious, rules-don't-apply-to-me behaviors, know that they totter on the brink of disaster daily. Not just drunken driving, but abuse of money, power, and rude mistreatment of decent people just to have what they want at any cost.
Karen Irby is now suffering the agonies of the damned - Wracked with her physical pain, loss of her beauty, her mobility to ambulate threatened. Additionally, she has to face not only did she take the lives of two people that did no harm to her, she has probably killed her husband - at least as he was to the ones who knew him before the accident. He may very well, in all likelihood never be the same, or even functional to his pre-accident status. Then there are the innocent children in this - I truly feel very sorry for them.
This is tragic all around, and compounded by lies, seemingly corrupt politics, and gross insults to the taxpaying public.
If you are choosing to withhold the test results on Karen Irby, just say so - We, the public can handle the truth no matter how ugly. But do not lie to us, and LIE about lying to us. That will never be acceptable.
I wish the Irbys well, but this post accident suffering cannot be counted as Karen Irby's punishment in this situation.

Probable cause exists for an immediate arrest while the rest of the process continues forward. McMillin is passing the political buck to Smith and the Grand Jury. Smith will take months before approaching an indictment.

In the flash of a moment two newly engaged young physicians, one who has shown great empathy and dedication to the less fortunate in our state, are suddenly hit head on. Witnesses report that the Mercedes Benz was traveling at a rate of speed far above the posted limit. The impact was so destructive a rapid fire fully engluffs Mark's truck burning him and Lisa beyond recognition. Two promising careers gone. Two futures never realized. Two families in mourning, forever changed.

McMillin is playing politics with two absolutely horrific deaths. He should be ashamed.

McMILLIN and LT.SCOTT, You must be the Voices for the two that lost there lives that night.You can,t allow this to go without some kind of punishment!!!!There are laws and Karen broke many that night.She and only she made the choices.Do the right thing here.You both took an oath to Protect the Citizens of J.M. now is the time i think you both will sleep better and be able to look yourselfs in the mirror and know that you did speak up for the silent.

I grew up with trust fund kids. Unfortunately relatives. One of them 'Karened' someone elses kid 25yrs ago. We're all just sorry she wasn't killed as well. She certainly hasn't amounted to anything.

I maintain: Useless vapid wastes of DNA. Apples, trees... Look at their parents to see where and what they'll be doing 25yrs from now.

I would love to be proven wrong.

Probably won't be though. They'll always be the children of murderers.

Karen and Stuart can rectify that though and turn over ALL trust fund monies these kids have to charity.

Karen is probably most concerned with:

1. Loss of her looks/mobility.

2. Possible loss of money.

Guaranteed she hasn't thought once about the people she killed. Not even when she saw their terrified faces a millisecond before she killed them.

Best thing for the kids would be foster care, adoption to someone else and concurrent name change.

Cuz you and I both know Karen and Stuart will walk...She might wear an ankle bracelet for a few months but will do no time.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
